ORGANIC CHARTER OF THE COPYRIGHT EXAMINATION AND MEDIATION COMMITTEE OF THE MINISTRY OF INTERIOR

 

Approved by Executive Yuan on August 11, 1992 per Memorandum No. Tai-(81)-Yen-Tsung-Tzu 3990; Promulgated by Ministry of Interior on August 28, 1992 per Letter No. Tai-(81)-Nai-Chu-Tze 8183016.

 

Article 1

This charter is enacted pursuant to the provisions of Article 83 of Copyright Law.

 

Article 2

The Ministry of Interior (hereinafter referred to as MOI) shall establish a Copyright Examination and Mediation Committee (hereinafter referred to as this Committee) to handle the matters provided by Article 82 of Copyright Law.

 

Article 3

This Committee shall post one Chairman to be concurrently posted by Minister of MOI, and fifteen to twenty-one Committee Members to be appointed by Minister of MOI for a concurrent post of two years from representatives of relevant government authorities, scholars, experts and relevant operational employee of MOI.

 

Article 4

This Committee shall post one Executive Secretary, three Secretaries, two to six Staffs, to be concurrently posted by relevant operational employees at MOI.

 

Article 5

The meetings of this Committee shall be convened and presided over by Chairman. In case Chairman is unable to attend the meeting, Chairman shall designate one Committee Member as the chairman of meeting.

 

Article 6

Resolutions of this Committee in handling the matters to be examined and consulted shall be only made by a Committee meeting with a quorum of not less than one half of the Committee Members and approval of not less than half of the attending Committee Members. In tight vote, resolutions shall be made by Chairman's decision.

In handling the matters to be mediated, this Committee should follow the Regulations of Copyright Dispute Mediation.

 

Article 7

This Committee may invite relevant persons to be seated in the meetings to proffer their opinions.

 

Article 8

All the concurrent-posted personnel of this Committee are at unpaid-posts. However, the concurrent posted personnel not employed by MOI may be paid a transportation fee or research fee in accordance with relevant regulations.

 

Article 9

The funds required by this Committee shall be budgeted in MOI's annual budget.

 

Article 10

This Committee should not issue official documents outside in its name; after its resolutions are approved by Minister of MOI, the official documents shall be made in the name of MOI.

 

Article 11

This Charter shall come into force from the date of promulgation.
